The Natural Resources and Conservation Authority and the National Environment and Planning Agency (NEPA) are moving to take legal action against Phil's Incorporated for not complying with Stop and Enforcement notices.

The enforcement notices were served on the company under the NRCA and Town and Country Planning Authority Acts on February 26.

The notices relate to construction works being undertaken by the company at 3 Central Avenue in Kingston for which the authorities say there is no planning permission.

The authorities also charge that the company is undertaking unauthorised dumping at the site, resulting in the blockage of the natural drainage system.

They say this causes the road to become impassable when it rains.

They say during heavy rainfall, students of the Queens High School and other nearby institutions are forced to use alternative routes to access the school.

The Authorities are now seeking a court injunction to stop the construction works.

In addition, NEPA says it will be working with the National Works Agency to restore the site to its original state and prevent further flooding of the area.
