Lawyers representing Curacaoan, Shureny Quant, are to continue their submissions before the Judicial Review Court today in the lawsuit seeking exemplary damages against the Jamaica government.

Yesterday, attorneys Chukwuemeka Cameron and Carolyn Reid Cameron argued that Quant’s deportation last year was unlawful.

The suit has been brought against Minister of National Security Peter Bunting, who signed off on Quant’s deportation.

There was a Supreme Court order in effect barring Quant’s removal from the country when he was deported in April last year.

The lawyers have contended that the national security minister did not give any explanation of the bases for Quant’s detention and deportation.

The lawyers further argued that Bunting also failed to give any evidence to the court.

They also said that the national security minister purportedly deported Quant under the Aliens Act but failed to comply with the correct wording in the law.

The law allows for the removal of someone who is deemed not to be conducive to the public good.

But the lawyers pointed out that in court documents Bunting said Quant was being deported because he was an undesirable person.

They argued that the term undesirable does not appear in the Aliens Act but is found in the Immigration Act.

The lawyers argued that when the State is seeking to limit the fundamental rights of an individual it must follow the letter of the law.

Meanwhile, the Curacaoan man’s lawyers argued that his deportation was a sham.

They argued that Quant was extradited to the Netherlands, where he was wanted on drug charges, under the guise of a deportation as there was no extradition treaty between that country and Jamaica.

Meanwhile, Quant has brought a contempt of court claim against the national security minister arguing that he unlawfully disobeyed a Supreme Court order which barred his deportation until there was a hearing.
